Welcome to envirotrendusa.com.  EnviroTrend provides website features to You subject to the following terms and conditions.  If You visit or purchase products from the Website, You accept these terms and conditions.  Please read them carefully.

PRIVACY

PRODUCT DESCRIPTIONS

EnviroTrend USA attempts to be as accurate as possible.  However, EnviroTrend USA does not warrant that Product descriptions or other content of this Website is accurate, complete, reliable, current, or error-free.  If a Product offered by EnviroTrend USA is not as described, Your sole remedy is to return it in unused condition.

PLACING AN ORDER AND PAYMENT

1.1 By completing a Purchase Order, You are making an offer to purchase the Product at the price set out in the Website, subject to any subsequent notification of price by EnviroTrend USA in accordance with section 1.5.

1.2 Payment must be made at the time of submitting the Purchase Order.  Payment can be made by credit card or debit card only.  EnviroTrend accepts Visa, MasterCard and Discover.  You warrant that You are an authorized user of the credit card used to complete payment in accordance with this section 1.2.

1.3 All Purchase Orders placed through this Website are subject to confirmation and acceptance by EnviroTrend.  We will email You with confirmation of the receipt of Purchase Order, and then acceptance by EnviroTrend will be upon Your receipt of the email confirming dispatch of the Product in accordance with section 2.4 and 2.5.  EnviroTrend may reject Your Purchase Order, and refund any payment made by You, at any time prior to Your receipt of this acceptance by EnviroTrend.

1.4 The Purchase Order must be paid in full immediately upon entry into the Agreement.  All transactions are settled in US Dollars (USD).  If You are ordering from outside the United States, and Your bank account or credit card is held in a different currency, You can still order by credit card - Your currency will automatically be converted to US Dollars when You complete the transaction.  The conversion rate varies from day to day with the current exchange rate.  Many banks also charge a currency conversion fee, contact Your bank or credit card provider for details.  The final charge to Your credit card is made in US Dollars and the ultimate conversion rate is determined by Your bank or credit card provider.  Therefore EnviroTrend does not take responsibility for the final amount charged to Your credit card.

1.5 EnviroTrend may vary prices in the event of price changes or mistakes on reasonable notice to You.  If EnviroTrend requests payment for increased prices, You may cancel the Purchase Order by giving notice to EnviroTrend, which must be received within 7 calendar days of the notice of the increase.

1.6 The secure credit card payment system is powered by Paymentech.  This Website is protected by SSL (Secure Socket Layer) encryption.  SSL is a security device which ensures that any data which You enter into a secure area of the Website is encrypted during transmission over the Internet.  SSL utilizes data encryption to create a secure environment for You to conduct Your online transactions.  In order for SSL to be effective, You must be using an SSL compliant web browser.

1.7 T his Website uses cookies to allow the web server to recognize You as a unique user when You visit.  These cookies are necessary for the proper functioning of certain data access features on the Website, such as the online shopping component.   Cookies allow programs running on the web server to keep track of Your Purchase Order data and any options You have specified, such as currency conversion rates.  The use of cookies is restricted to allowing the web server to recognize You as the same visitor to the Website each time You interact with the data-driven features of the Website.  Though cookies uniquely identify You to the web server, they do not personally identify You, therefore it is not possible for us to determine Your name or email address from the cookies we place on Your computer.  

1.8 The cookies that are placed on Your computer when You visit the Website are known as session cookies.  These session cookies originate from our web server, and cannot be accessed by any web server other than ours.  Session cookies are temporary cookies which are necessary for the proper functioning of the Website.  They automatically expire approximately 20 minutes after You have ceased viewing pages on our Website, and therefore cannot be used to recognize You on subsequent visits to the Website.  

1.9 EnviroTrend does not store or keep credit card numbers from online transactions.  The last four numbers and the expiration date of Your credit card number are kept for Purchase Order verification and identification purposes only.  While every effort is made to ensure every shopping experience with us is a good one, in the event a credit card is used without the holder's authorization, the card holder must notify their credit card provider in accordance with their reporting rules and procedures.

1.10 EnviroTrend reserves the right to limit the quantities of product sold as it sees fit.  With the exception of wholesalers previously approved by EnviroTrend, it is a condition of this Agreement that You do not resell the Products to a third party.

1.11 The Website is owned and operated by EnviroTrend.  This Agreement supersedes all prior agreements and may be revised by EnviroTrend from time to time.

1.12 This Agreement must be read in conjunction with the Shipping Policy , Returns Policy and Privacy Policy .  These documents form a part of this Agreement.

YOUR ACCOUNT

If You use this Website, You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your computer, and You agree to accept responsibility for all activities that occur under Your account or password.  EnviroTrend does not sell Products to children, but it does sell them to adults, who can purchase with a credit card or other permitted payment method.  If You are under 18, You may use the Website only with involvement of a parent or guardian.  EnviroTrend reserves the right to refuse service, terminate accounts, remove or edit content, or cancel Purchase Orders in their sole discretion.

SHIPPING POLICY

2.1 EnviroTrend delivers to most destinations around the world.

2.2 Purchase Orders placed within Texas or goods shipped to a Texas residence are subject to Texas state sales and use tax.  Purchase Orders placed outside the United States may be subject to the relevant taxes and/or duties applicable to the jurisdiction from which the Purchase Order was placed.

2.3 EnviroTrend uses United Parcel Service to deliver Products outside of the United States.  Deliveries of Products within the United States are shipped using United Parcel Service or a reputable courier company of our choice.

2.4 EnviroTrend's freight charges are calculated using the automatic freight calculator within the Website. 

2.5 EnviroTrend will use reasonable efforts to arrange shipping of the Product within 2 business days of You submitting the Purchase Order.

2.6 Expected delivery times are:

2.6.1    within 14 business days for international deliveries; and

2.6.2    within 7 business days for domestic deliveries.

2.7 The expected delivery times set out in section 2.6 are estimates only.  EnviroTrend will not be liable to You for any loss or damage You suffer if the Product is not delivered within the timeframes set out in section 2.6.

2.8 Risk and title in the Product will pass to You upon delivery of the Product.

RETURNS POLICY

Returns by You for change of mind:

3.1 EnviroTrend will not provide a refund or exchange because of a change in mind.

Returns by You for faulty or damaged Product:

3.2 If You wish to return faulty or damaged Product, EnviroTrend will gladly repair, exchange or refund the original price in accordance with the following process:

a.     You must notify EnviroTrend within 14 calendar days of receiving the Product with the flaw or damage, and then arrange return of the Product to EnviroTrend within 7 calendar days after such notification.

b.     You must notify EnviroTrend by emailing sales@envirotrendusa.com  to obtain a "Return ID number", or call EnviroTrend between 10:00 AM and 4:00 PM (Central Standard Time) Monday through Friday.

c.     You must provide a "proof of purchase" being either an invoice, bank statement, email confirmation from EnviroTrend, or shipping receipt.

d.     You must return the Product to the following address: EnviroTrend Web Returns, P.O. Box 79411, Houston, Texas 77279, United States.

e.     If it is a return from a country outside the United States, You must mark on the postal company's consignment note that it is a return/replacement, so that the Products do not attract possible customs duties and taxes again.

f.     EnviroTrend will pay for the shipping costs on returns of faulty or damaged Product.

g.     EnviroTrend will then refund the Price to You in full.

h.     Refunds can only be credited back to the credit card that was used to make the original purchase.  The refund will be processed as soon as the items have been received by EnviroTrend, however, please allow 14 calendar days from the day You return the Product for Your account to be credited.

i.     Exchanges are only possible if the item is available.  EnviroTrend can only exchange faulty items for the same item in the same style, subject to availability.  If You wish to exchange, please make Your request clear when requesting Your Return ID number.

ELECTRONIC COMMUNICATIONS

When You visit the Website or send e-mails to us, You are communicating with us electronically.  You consent to receive communications from us electronically.  We will communicate with You by e-mail or by posting notices on the Website.  You agree that all agreements, notices, disclosures and other communications that we provide to You electronically satisfy any legal requirement that such communications be in writing.

LICENSE AND SITE ACCESS

EnviroTrend grants You a limited license to access and make personal use of this Website and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of EnviroTrend.  This license does not include any resale or commercial use of this Website or its contents; any collection and use of any Product listings, descriptions, or prices; any derivative use of this Website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

This Website or any portion of this Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of EnviroTrend.  You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of EnviroTrend without express written consent.  You may not use any meta tags or any other "hidden text" utilizing EnviroTrend’s name or trademarks without the express written consent of EnviroTrend.

You agree that You will use the Website in accordance with these terms and conditions and that You will not use the Website for any unlawful purpose.   You will not violate or attempt to violate the security of the Website.  You will not hack into the Website, EnviroTrend's computer systems or the computer systems of other users of the Website.  Hacking means unauthorized access, malicious damage and/or interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.

Any unauthorized use terminates the permission or license granted by EnviroTrend.  You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of Website so long as the link does not portray EnviroTrend, or its Products or services in a false, misleading, derogatory, or otherwise offensive matter.  You may not use any EnviroTrend logo or other proprietary graphic or trademark as part of the link without express written permission.

All content included on the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of EnviroTrend or its content suppliers and protected by United States and international copyright laws.  The compilation of all content on this Website is the exclusive property of EnviroTrend and protected by U.S. and international copyright laws.  All software used on this Website is the property of EnviroTrend or its software suppliers and protected by United States and international copyright laws.

EnviroTrend reserves the right to terminate this Agreement at any time.   Subject to the following sentence, EnviroTrend shall not be liable to You for any cost, expense, or damages whatsoever for terminating this Agreement.   If the Product has not been delivered to You prior to any termination of this Agreement by EnviroTrend, EnviroTrend will refund to You any payment You have made prior to the termination.
